So next they'll be suing manufacturers of mp3 encoding software because some people might use to illegally encode music and computer manufacturers for providing the enabling technology.

Why not just show the law up to be a total arse and sue the mail system for 'profitting from the transport of pirated CDs' and the telecomms companies for permitting the transmission of pirated material ...

This sounds like a VERY dangerous precedent to set.
