An important fact that seems to have been overloooked is that Spamhaus does not itself "blocked, delayed, altered, or interrupted in anyway" any message. They only provide an opinion as to whether any particular IP address is used to send spam. The service is effective and I use it myself.

What does worry me about this judgement is this : if anyone related to Spamhaus were to visit the US, would they run the risk of being arrested and 'processed' by their clearly screwed up legal system ?
