To Anonymous - it's easy ! All the company has to do is keep quiet about an existing patent while the standard is being discussed. Then once the equipment/whatever is out there, they have a patent covering part of the standard and are entitled to capitalise on it.

One area I suspect the patent is being challenged on is that it must be hard for Csiro to claim that they knew nothing whatsoever about the technology going into the standard - hence they could be held to have abandoned the patent by failing to protect it.

Whatever the outcome, it's going to take a long time to settle and cause a lot of headaches.
