So if my neighbour causes the transmission of his Wifi network into my property and my laptop "unwittingly" picks up the signal and DHCP network config, I am guilty?

Surely the neighbour is guilty of conspiring to cause unauthorised WiFi usage if he/she doesn't encrypt the WiFi transmission.
