I'd still like to know how the ISPs (and subsequently any law enforcement organisation) is going to determine whether the content of a shared file is under copyright or not? The only way that i can think of to do this is to inspect the content of each download. Surely this raises questions around both the legality of this action and the sheer amount of resource involved to do this?
