What determines an "illegal" download?

If i share music i made myself with the WWW could that be determined as illegal if the quantities are big enough to raise suspicion?

If not, then it must be determined by the filenames of what you download. If this is so, then wouldnt illegal sharers just alter the filenames of the illegal material?

Are they going to listen to every transfered mp3 to see if they recognise it?

I just dont see how this is going to catch the tech savvy file sharer, without the internet becoming a policed, politically motivated arena.
